Since October 2, 1981, any individual who considers themselves the victim of a violation by France of the European Convention on Human Rights can contact the Strasbourg commission. Only one condition: having appealed to the Court of Cassation, that is to say having exhausted internal remedies.
For the Minister responsible for European Affairs André Chandernagor, the recognition by France of the right of individual appeal provided for in Article 25 of the Convention crowns "years of hope". For the Minister of Justice Robert Badinter, who formalized this recognition with his colleague, it is “an act of faith by France in its justice and its institutions”.
“France,” declared Mr. Badinter, “once again demonstrates its desire to pursue an exemplary policy in the service of freedoms.” He cited in this regard the abolition of the State Security Court and the ABOLITION OF THE DEATH PENALTY (September 18, 1981), as well as future reforms of the penal code and the status of the judiciary.
